What Are the Grounds for Relief in Removal Proceedings?

  • Adjustment of Status

    Eligible only for immigrants with a familial relationship with a U.S. citizen or a permanent resident to apply for a green card to obtain permanent residence. Only potentially eligible for those who entered the country lawfully, with very limited exceptions.

  • Cancellation of Removal

    allows certain immigrants to either obtain or maintain their green cards if they have been in the US for an extended period, have a qualifying family member, can show good moral character, and have not been convicted of certain crimes. This is an extremely high threshold, especially for those who do not have green cards prior to the removal hearing. There is also potential Violence Against Women Act (VAWA) Cancelation for certain abused spouses or children of permanent residents or US citizens.

  • Asylum

    Withholding of Removal and Convention Against Torture (CAT) Relief – With reasonable and credible fear of being persecuted or tortured if an immigrant is to be deported to a country, Asylum may be granted in removal proceedings if they meet this relief option.

  • Voluntary Departure

    Leaving of your own will, with your own money, may avoid the admissibility consequences of being ordered deported. Typically given 60-120 days to leave. However, this does not necessarily remedy any other grounds of inadmissibility on leaving the U.S.

  • Entering the United States illegally
  • Having one or more criminal convictions or being convicted of an aggravated felony
  • Violating terms of their visa or failing to maintain their status
  • Committing fraud of any kind, especially as it pertains to potentially gaining an immigration benefit. This can include entry into the U.S. with false documents, or simply withholding potential material information from a government or immigration official, amongst others
